1.3 We reserve the right to change these Terms from time to time.

2. Use of Service

2.1 You can use the service only to provide feedback to someone in the organisation to help improve the organisation or tackle a problem or potential problem. We reserve the right in our absolute discretion to not pass on any message if we see fit.

2.2 You shall not:

2.2.1 use any automated system to access the service;

2.2.2 use the service for commercial purposes;

2.2.3 post comments that we might, in our sole discretion, consider to be malicious, discriminatory, bullying, intimidating, harassing, offensive, inappropriate, defamatory or otherwise unlawful;

2.2.4 breach any laws, third party rights or these Terms.

2.3 If your organisation uses SpeakInConfidence please use that instead. We reserve the right to not pass on comments sent via MakeMyWorkBetter if your organisation is a SpeakInConfidence client.

3. Our Proprietary Rights

All Intellectual Property Rights in the service are the property of SpeakInConfidence. If you submit comments about the service we are free to use them unless they are clearly confidential.

4. Eligibility

The Service is solely for use by persons aged 16 or older.

5. Cancellation or suspension of Service

We may, at our sole discretion, suspend or terminate the service at any time.

6. Warranty and Limitation of Liability

6.1 The service is provided on an “as is” basis, and use is at your own risk.

6.2. To the extent permitted by law, we assume no liability for (i) service errors or inaccuracies, (ii) user communications or the defamatory, offensive, or illegal conduct of any third party.

6.3 To the extent permitted by law, SpeakInConfidence, its directors and employees shall not be liable for any direct, indirect, special, consequential or exemplary loss or damages arising out of or in connection with use of the service.

7. General

7.1 This agreement may not be transferred or assigned by you but may be assigned by SpeakInConfidence.

7.2 These Terms are governed by English Law and subject to the exclusive jurisdiction of the English Courts.

7.3 If any provision of these Terms is deemed invalid it shall not affect the validity of the remaining provisions.
